Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website at thehermitsway.com (the "Site"), operated by Gallarus Advisors, LLC ("Gallarus," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What the Site is — and is not

The Site is an informational and marketing website for The Hermit's Way (the "Hermit's Way: Tarot Journal" application), a reflective tarot-practice application. The Site describes the application, its decks and features, and directs visitors to download the application from the Apple App Store and Google Play.

The Site is not the application. It does not provide the Hermit's Way practice itself, does not host user accounts, and does not process payments. Specifically, on this Site there is:

• no user registration or account;
• no login or user-generated content;
• no purchase, subscription, or payment of any kind.

2. The Hermit's Way application is governed by separate terms

The Hermit's Way application is distributed through the Apple App Store and Google Play. Your download and use of the application, and any purchases made within it, are governed by:

• the in-application terms and end-user license agreement presented with the application; and
• the terms and policies of Apple Inc. and/or Google LLC, as applicable to your platform.

These website Terms do not govern your use of the application. Nothing on the Site is an offer to sell, or a contract for, the application or any subscription.

3. Purchases and subscriptions are handled in-app by the platforms

The Hermit's Way offers an optional paid subscription ("Hermit's Way Plus") only within the application. All purchases, billing, renewals, and cancellations are processed by Apple or Google through their in-app purchase systems, subject to their terms and their refund policies. We do not sell subscriptions, collect payment card information, or process payments on this Site or anywhere on the web.

4. Eligibility

The Site is intended for adults. You must be at least 18 years old to use the Site. If you are under the applicable age, do not use the Site.

5. Intellectual property

The Site and its contents — including the Hermit's Way and Hermit's Way: Tarot Journal names and marks, the Midnight Line Deck and all of its card text and imagery, and all original written content, design, and layout — are owned by Gallarus Advisors, LLC or licensed to it, and are protected by copyright, trademark, and other laws. The Rider–Waite–Smith (Smith-Waite) tarot imagery is in the public domain; the accompanying written interpretations are our original content. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Site or its contents without our prior written permission, except as permitted by applicable law.

6. Acceptable use

You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to the Site or its systems;
• interfere with or disrupt the Site, or introduce malware or harmful code;
• scrape, harvest, or collect data from the Site by automated means except as permitted by our robots policy; or
• misuse our marks or content.

7. Third-party links and services

The Site contains links to third-party services, including the Apple App Store and Google Play. We do not control and are not responsible for third-party services, their content, or their terms and privacy practices. Following such links is at your own risk and subject to those third parties' terms.

8. Privacy and data protection

Our collection and use of personal data through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference. The following summarizes how the Site handles personal data and the rights of individuals in the European Economic Area ("EEA"), the United Kingdom, and other jurisdictions with comparable laws.

8.1 Data controller

8.2 What we process on the Site

The Site is designed to collect as little personal data as possible. We process:

• Privacy-respecting analytics — aggregate, non-identifying usage statistics collected without cookies and without building profiles of visitors; and
• Contact data — if you email us, the email address and contents you send.

The Site does not use advertising or tracking cookies, does not sell personal data, and does not require consent banners for non-essential cookies.

8.3 Lawful bases (GDPR Art. 6)

Where GDPR applies, we rely on: our legitimate interests in operating, securing, and understanding use of the Site (aggregate analytics); and consent and/or legitimate interests for responding to your communications. Where we rely on consent, you may withdraw it at any time.

8.4 Your rights

Subject to applicable law, you have the right to: access your personal data; rectify inaccurate data; erase data; restrict or object to processing; data portability; and, where processing is based on consent, to withdraw consent. 8.5 International transfers

Gallarus Advisors, LLC is located in the United States. Personal data processed through the Site may be transferred to and processed in the United States and other countries. Where required, such transfers are made under appropriate safeguards, such as Standard Contractual Clauses.

8.6 Retention

We retain personal data only as long as necessary for the purposes described, or as required by law.

9. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

The Site and the Hermit's Way application are tools for personal reflection. They are not medical, psychological, therapeutic, or professional advice, and are not a substitute for care from a qualified professional.

10. Limitation of liability

To the fullest extent permitted by law, Gallarus Advisors, LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Site. Our total aggregate liability arising out of or relating to the Site will not exceed USD $100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights.

11. Indemnification

You agree to indemnify and hold harmless Gallarus Advisors, LLC from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.

12. Changes

We may modify the Site or these Terms at any time. Revised Terms take effect when posted, with an updated "Last updated" date. Your continued use of the Site after changes constitutes acceptance. For material changes affecting your rights, we will take reasonable steps to make the change apparent.

13. Governing law and dispute resolution

These Terms are governed by the laws of Connecticut, United States, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in Stamford, Connecticut. This provision does not deprive consumers in the EEA or United Kingdom of the protection of mandatory local law or the right to bring proceedings in their local courts.

14. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. Our failure to enforce a provision is not a waiver.
